- Introducción:
La Tesorería General de la Seguridad Social (TGSS) es el organismo encargado de la recaudación de todos los recursos de la Seguridad Social, tanto en período voluntario como en vía ejecutiva, pudiendo apremiar el patrimonio del deudor. A tal efecto, está facultada por la Ley para embargar sus bienes y venderlos en pública subasta para, con el fruto de la enajenación, cobrarse la deuda pendiente y saldar el débito perseguido.

Las subastas son la última fase del procedimiento administrativo de apremio y mediante las mismas los órganos de recaudación de la Tesorería General de la Seg-Social tratan de poner en el mercado los bienes previamente embargados a los deudores de la Seguridad Social.

El producto que se obtiene en las subastas se destina a saldar la deuda pendiente de los apremiados, y en el caso de haber sobrante se entrega a los mismos.

Desde el punto de vista de los deudores, la posibilidad que tienen éstos de paralizar el procedimiento, en cualquier fase anterior a la adjudicación de los bienes, mediante el pago de la deuda que mantienen con la Seguridad Social, hace que muchos de los lotes comprometidos en las subastas se retiren por dicha causa.

- Bienes embargados para subastas:
La Tesorería General de la Seguridad Social enajena, mediante pública subasta, fincas (rústicas y urbanas), vehículos, embarcaciones, maquinaria de diverso tipo, mobiliario de oficina, material ofimático y toda clase de bienes muebles o inmuebles embargados a los deudores de la Seg-Social.

- Publicidad de las subastas ejecutivas de bienes embargados:
La Tesorería General de la Seguridad Social, como consecuencia de los procedimientos de apremio que sigue contra los deudores de la misma, está obligada a anunciar las subastas que celebre para la venta de los bienes embargados y, de esta forma, posibilitar que cualquier persona interesada pueda acudir y licitar en las mismas.

- ¿Quiénes pueden participar?
Con excepción del personal de la Unidad de Recaudación Ejecutiva, de los tasadores, de los depositarios de los bienes y de los funcionarios directamente implicados en el procedimiento de apremio, cualquier persona, por sí o por medio de representante, que posea la capacidad de obrar con arreglo a derecho y no esté incursa en las excepciones e incompatibilidades que marcan las leyes.

- Requisitos:
Para poder participar en las subastas es necesario: 

Identificarse debidamente, bastando la simple exhibición en el acto público o incluyendo en el sobre cerrado copia del Documento Nacional de Identidad o, tratándose de extranjeros, del pasaporte, del título de viaje o de otro documento que acredite su identidad . Asimismo, acreditación de la representación con que, en su caso, se actúe.

Consignar el 25 por 100 del precio de salida (tipo de subasta) del bien por el que se desee pujar, mediante cheque certificado, visado o conformado por el librado y a nombre de la Tesorería General de la Seguridad Social, que se acompañará a la postura que se realice en sobre cerrado, o del 30 por 100 de dicho precio si la postura es verbal en el acto público de la celebración de la subasta.

En el resguardo justificativo de la consignación o del depósito es necesario que conste, a efectos de posibles adjudicaciones, la hora y el minuto en que se haya realizado dicha entrega así como el número de orden que le haya correspondido.
